Our client submitted to a standardized field sobriety test known as the Horizontal Gaze Nystagmus test (xe2x80x9cHGNxe2x80x9d) and was charged with DUI. At trial the arresting officer asserted that our client failed the test. The Judge would not consider the officer’s testimony when our office pointed out that the officer did not administer the test properly and did not testify that her training was in accordance with the standards set forth by the National Highway Traffic & Safety Administration (xe2x80x9cNHTSAxe2x80x9d). Our office relied on People v. McKown 126 Ill. 2d 278; 924 N.E.2d 941; Ill. LEXIS 270; 338 Ill. Dec. 415 (2010) and the Judge would not consider the results of the HGN test. Our client was found not guilty of 2 counts of DUI.
