Our client was accused of felony Unlawful Use of A Weapon after he was pulled over for a seatbelt violation and the police found a handgun in the back seat of his SUV. Our office filed a motion arguing that our client’s vehicle was illegally searched on the grounds that the officers did not obtain a warrant and did not have probable cause to believe the vehicle contained contraband. The state argued that a warrant was not necessary because the gun was visible in plain view inside an unzipped duffel bag. Our office brought the duffel bag to Court and the Judge was able to ascertain that the gun would not have been visible from the officer’s vantage point even if the bag was unzipped. The Judge suppressed the gun from evidence and the State was forced to dismiss the case.
