The client was pulled over for swerving into a lane of traffic and almost striking another vehicle. The client admitted to consuming two beers and a glass of wine. At trial a highly experienced judge reviewed the video with a discriminating eye and although my client had trouble with the walk and turn and one-legged stand field sobriety tests reasoned that other factors raised a reasonable doubt as to whether my client’s driving was impaired due to his stated consumption of alcohol. My client was found not guilty of the criminal charge of DUI. However, the court sustained my client’s one (1) year driving suspension reasoning that there were sufficient reasonable grounds to affirm the suspension.
