Description: My client was pulled over by the Gurnee Police Department for failing to signal. She admitted to consuming alcohol but performed well on the Field Sobriety Tests. She submitted both portable and regular breath samples in excess of a .08 Blood Alcohol Content. However, she initially refused the Portable Breath Test (“PBT”) but the arresting officer pressured her into taking the test. On November 27, 2018, the Judge suppressed the PBT and determined that her performance on the field sobriety tests did not indicate sufficient impairment for probable cause to arrest my client. The DUI charge was subsequently dismissed and my client pled guilty to the petty traffic offense of failing to signal.
