Description: People v. AH, Citation No. YH255466-68 | My client, a second DUI offender, was involved in an accident, was investigated and arrested for DUI by the Chicago Heights Police Department. He provided a breathalyzer sample in excess of .16 blood alcohol content at the police station. I successfully argued a Motion to Quash Arrest in that my client had not performed any field sobriety tests prior to being arrested and moved to the police station to perform the tests. Based on the suppression of all evidence after the unconstitutional arrest, the State had my client plead guilty to a lane usage violation (a petty offense) in return for supervision (a non-conviction), a $300 fine and a Victim Impact Panel.
